1. In case you choose to use the Drummerszone.com website and it's services ("DZ"), you will be agreeing to abide by all of the terms and conditions as described here: a contract between you and Drummerszone.com. At any time Drummerszone.com may change, add or remove portions of this statement, but if we do so, it will be announced by posting such changes on the website.
2. You may request for a deactivation of your membership if any of these rules or any future changes are unacceptable to you. You may place this request by sending an e-mail to: accounts@drummerszone.com. If you choose to go allong with the following statements and rules you indicate your acceptance acceptance and abiding by you of such rules, changes, or modifications.
3. At any time Drummerszone.com may change, suspend or discontinue any aspect of DZ, including the availability of any service feature, database, or content. Drummerszone.com may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.
   DZ may, in its sole discretion, terminate or suspend your access to all or part of the Drummerszone for any reason, including, without limitation, breach or assignment of this little agreement we have now.

When you register

1. You must provide personal information as part of the registration process. All of this information must be accurate and updated.
2. You may not select or use a username of another person with the intent to impersonate that person.
3. You may not use a username in which another person has rights without such person's authorization.
4. You may not use a username that DZ, finds offensive. If you do not comply with the foregoing it means a breach of this agreement, and because of that it may result in immediate termination of your account.
5. You shall be responsible for maintaining the confidentiality of your password.
   You shall notify help@drummerszone.com of any known or suspected unauthorized use(s) of your account, or any suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.
6. Persons of all ages may make use of DZ.
7. You are responsible for all usage or activity on your Drummerszone.com account, including use of the account by any third party authorized by you to use your username and password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account.
8. Drummerszone.com, all of its contents and other activities are intended for your personal use. All materials published on Drummerszone.com (including, but not limited to texts such as news articles, interviews and reviews, audio clips, video clips, photographs, images and illustrations, also known as the "Content") are protected by copyright, and owned or controlled by Drummerszone, DZ, Drummerszone.com, or the party credited as the provider of the Content. You shall accept and abide by all additional copyright notices, information, or restrictions contained in any Content accessed through DZ.
9. When you are under 13 years old your parents/guardians have to agree on your registration on DZ or any of it's affiliates. By signing in or with participating in other activities on DZ, we assume everybody on DZ is acqainted with our Rules and Engagements. Drummerszone.com accepts memberships of children younger than 13. We think it is actually 'cool' for a member to add activities and info as a member on drummerszone.com. Therefore we are willing to accept every registration, despite the age of the registrant. However, DZ is NOT responsible for misuse or misconduct in any way of members or others (i.e. visitors) on DZ. Parents, guardians and curators, as well as the members themself, are solely responsible for their actions on DZ.

Content & Rights

1. The whole of DZ is protected by copyright pursuant to Dutch and international copyright laws. You may not publish, modify, transmit, participate in the transfer or sale of, reproduce (except as stated in the next section of this agreement), create new works from, distribute, display, perform or in any way exploit, any of the content or the service in whole or in part.
2. You may NOT download or copy the Content and other downloadable items displayed on DZ except when otherwise mentioned. You must maintain all copyright and other notices contained therein.
3. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from Drummerszone.com, or the copyright holder identified in the copyright notice contained in the Content.
4. Certain Content is furnished by newsgathering organizations like Algemeen Nederlands Persbureau (ANP), Associated Press (AP) and Reuters, which will not be liable for any delays, inaccuracies, omissions, errors or other mistakes in any such Content, or in the transmission or delivery of all or any part thereof, or for any damages arising therefrom.
5. The Forums shall be used only in a noncommercial manner. You shall not, without the express approval of DZ, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.
6. DZ encourages active discussions and welcomes debate in our Forums. But personal attacks are a direct violation of our (and yours) goal to become a understanding and open community. Violation of these goals and targets are grounds, by our discretion, for immediate and permanent suspension of access to all or part of DZ. Therefore you shall use respectful language. Like any community, the Forums flourish only when our Members feel welcome and safe. You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of DZ.
7. You agree that you will not threaten or verbally abuse other Members, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or spam. You shall not distribute or otherwise publish on DZ any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.
   You are solely responsible for the content of your messages. However, while DZ does not and cannot review every message posted by you on DZ and is not responsible for the content of these messages. DZ reserves the right to delete, move, or edit messages that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.
8. You acknowledge that any submissions you make to DZ may be edited, removed, modified, published, transmitted, and displayed by DZ and you waive any moral rights you may have in having the material altered or changed in a manner not agreeable to you. By submitting a Members' Review, you are consenting to its display on the site and for related online and offline promotional uses.
9. Any person involved in or affiliated with the production of a work reviewed on Drummerszone.com may not submit a Members' Review for that work or competing works.
   You may not sublicense, assign or transfer any licenses granted by DZ, and any attempt at such sublicense, assignment or transfer shall be null and void. You may not copy, distribute, modify, reverse engineer, or create derivative works from DZ.

Communications

1. To improve our Web site and better understand our users, DZ may contact you via e-mail regarding your participation in user surveys, asking for feedback on the Web site and existing or prospective products and services. This information will not be shared with third parties, except in aggregate form.
2. DZ reserves the right to disclose information about your usage and demographics, provided that it will not reveal your personal identity in connection with the disclosure of such information. Only in case you indicate your acceptance advertisers and/or Licensees on our Web site may collect and share information about you. For more information please read the Privacy Policy of Drummerszone.com. For the purpose of informing you of changes or additions to DZ, DZ reserves the right to send electronic mail to you.
3. In the event you have a claim of copyright infringement with respect to material that is contained in DZ, please notify copyrights@Drummerszone.com
4. If you believe that your work has been copied and is accessible on DZ in a way that constitutes copyright infringement, you may notify DZ by providing the following information, as required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (DMCA), to copyrights@Drummerszone.com
   • A physical or electronic signature of person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
   • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
   • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit DZ to locate the material;

Payments, costs and reclamation

1. DZ reserves the right to charge fees for access to portions of DZ as a whole at any time. However, unless we obtain your prior agreement to pay such charges, you will not be charged for access to DZ. If at any time DZ requires a fee for part of DZ that are now free, DZ will give you advance notice of such fees and the opportunity to reconsider you activities on DZ before such charges are imposed.
2. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any products or services offered for sale through DZ or by any other vendor. All fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of DZ through your account.
3. We can process returns and refunds only for items directly purchased from drummerszone.com. That is, items such as online accounts or advertising accounts on drummerszone.com or the Dutch website 'slagwerkwereld.com'. For items that are shipped/fulfilled by any artist or other vendor, you should contact their administration. For DZ pays transactions directly to merchants who have shops on DZ or slagwerkwereld.com:
4. If you receive an item different than what was described, or that is clearly in worse condition than indicated, please contact your seller directly via e-mail. You should be able to reach an amicable agreement with one another. If necessary, you can return your item to the seller for a refund. Please note that items purchased from drummerszone.com or slagwerkwereld.com sellers need to be returned directly to the seller and not to Drummerszone.com.
5. All products must be returned in original condition including but not limited to packaging, documentation, warranty cards, manuals, and accessories. Returns that do not include all the accessories may be returned to the customer or charged on a per item basis by the seller. No exchanges or refunds have to be authorized for any packages not returned in original condition.

Terms of Warranty / Guarantee

1. Drummerszone.com ("DZ") makes no warranty that the service will meet your requirements, the service will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the service will be accurate or reliable, the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and any errors in the software will be corrected.
2. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
3. No advice or information, whether oral or written, obtained by you from DZ or through or from the service shall create any warranty not expressly stated in these terms of use.
4. Drummerszone.com ("DZ") disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed on drummerszone.com or slagwerkwereld.com. DZ disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any information or material. Drummerszone.com disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the services of DZ.
5. The DZ services, and all materials, information, products and services included in the DZ services are provided "as is," with no warranties whatsoever. Drummerszone.com and its licensors expressly disclaim to the fullest extent permitted by law all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. Drummerszone.com and its licensors disclaim any warranties regarding the security, reliability, timeliness, and performance of the DZ services. Drummerszone.com and its licensors disclaim, any warranties for any information or advice obtained through the DZ services. Drummerszone.com and its licensors disclaim any warranties for services or goods received through or advertised on the DZ services or received through any links provided by the DZ services, as well as for any information or advice received through any links provided in the DZ services.
6. You understand and agree that you download or otherwise obtain material or data through the use of the DZ services at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download of such material or data.

Limitation of liability

• You expressly understand and agree that DZ shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if DZ has been advised of the possibility of such damages), resulting from: (1) the use or the inability to use the service; (2) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (3) unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the service; or (5) any other matter relating to the service.notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.

Representations

1. You represent, warrant and covenant (1) that no materials of any kind submitted through your account will (a) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or (b) contain libelous or otherwise unlawful material; and (2) that you are at least twelve years old. You hereby indemnify, defend and hold harmless DZ and Drummerszone.com, and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of this agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. DZ reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
2. Neither DZ nor Drummerszone.com endorse or represent the reliability or accuracy of any opinion, advice, statement, memorandum, or other information displayed, uploaded, or distributed through DZ by any user, information provider or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk. DZ and all downloadables are distributed on an "as is" basis without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You hereby acknowledge that using DZ is at your sole risk.
3. Drummerszone.com contains links to other related World Wide Web Internet sites, resources, and sponsors of Drummerszone.com. Since DZ is not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external (hyper)link to the site administrator or Webmaster of such web site.
4. This agreement has been made in and shall be construed and enforced in accordance with Dutch law. Any action to enforce this agreement shall be brought in the federal or state courts located in The Netherlands. Notwithstanding any of the foregoing, nothing in this agreement will serve to preempt the promises made in Drummerzone.com on the Web Privacy Policy.
